1. Acceptance of Terms

By accessing or using Moodify.fit (“Service”), you irrevocably agree to these legally binding Terms under Indian law. Continued use constitutes acceptance.


2. Eligibility Requirements

  • Minimum Age: 13 years
  • 13-17 Year Olds: Require parental consent
  • Prohibition: Users barred under Indian mental health/cyber laws

3. Account Security

  • Maintain password confidentiality
  • Report unauthorized access immediately to contact@moodify.fit

4. License Grant

Revocable, non-exclusive license to:

  • Access soundscapes for personal/non-commercial use
  • Utilize chatbot for general wellness support
  • Strictly Prohibited: Commercial exploitation, reverse engineering

5. Prohibited Conduct

You expressly agree not to:

  • Submit violent/abusive content via chatbot
  • Use Service while operating vehicles/machinery
  • Violate IT Act 2000 (e.g., data theft, cyberbullying)

6. Intellectual Property

All rights reserved for:

  • Soundscape libraries and algorithms
  • Chatbot training models and dialogue structures
  • Trademarks (“Moodify.fit”) and interface designs
    Unauthorized use triggers penalties under Copyright Act 1957.

7. Critical Disclaimers & Emergency Protocol

⚠️ LIFE-THREATENING SITUATIONS (MANDATORY READING)
Moodify.fit IS NOT designed for crises. Discontinue use immediately if experiencing:

  • Suicidal ideation or self-harm urges
  • Medical emergencies requiring intervention
  • Psychotic episodes or harm-to-others intentions

CHATBOT LIMITATIONS:

  • Cannot recognize or respond appropriately to crises
  • AI-generated responses may be harmful in emergencies

8. Termination Rights

We may suspend/terminate accounts for:

  • Violations of Section 5 or 7
  • Law enforcement requests
  • Extended inactivity (>12 months)

9. Limitation of Liability

To maximum extent permitted under Indian law:

  • Liability Cap: ₹1,000 INR
  • Excluded Damages:
  • Bodily injury, emotional distress, or death
  • Reliance on chatbot advice
  • Failure to seek emergency care
  • Use in hazardous conditions
  • No liability for third-party actions

10. Dispute Resolution

  • Governing Law: Indian law (excluding conflict principles)
  • Exclusive Jurisdiction: Courts in Delhi
  • Mandatory Cooling-off Period: 30 days mediation via contact@moodify.fit

11. Grievance Redressal

As per IT Act 2000:

  • Grievance Officer: Rajesh Verma
  • Response Time: 48 business hours

12. Modifications

Updates effective upon:

  • Email notification to registered users
  • 7-day in-app banner display
    Continued use = binding acceptance.

13. Complete Agreement

These Terms supersede all prior agreements. Severability: Invalid clauses don’t void remaining Terms.
